Model Booking Terms

These terms apply when a brand, agency, photographer or production books a model through Ms Curvaceous Model Agency. If you are booking a shoot, workshop or course for yourself, our model development terms apply instead.

1. Who you are contracting with

Bookings are made with Ms Curvaceous Model Agency, operated by Ilori Streamline Ltd, trading as Ms Curvaceous UK. In these terms "we" and "the Agency" mean Ms Curvaceous Model Agency, and "you" means the person or company booking the model.

2. Booking fees

  • Full day: 8 hours.
  • Half day: 4 hours.
  • Minimum booking: 2 hours.

Excluding equity contracts, a model's time is charged at the hourly rate unless a half day or full day booking has been arranged in writing beforehand.

3. Overtime

Overtime is charged at the agreed hourly rate, rounded up to the next hour. Overtime rates apply outside 0900 to 1800 and on any booking longer than 8 hours. Between 1800 and midnight the rate is 150% of the normal daily rate. Between midnight and 0900 it is negotiated. Work on Sundays and bank holidays is 200% of the daily rate.

4. Invoicing and payment

A 50% deposit is due at the time of booking. That deposit is not refundable unless the Agency cancels the booking. Invoices are payable within 14 days of the invoice date. The person booking the model is invoiced and is solely responsible for payment unless agreed otherwise at the time of booking, and the Agency reserves the right to invoice the ultimate client.

5. Travel

Time spent by a model travelling to or from your venue is charged at half the hourly rate. This applies to travel outside a five mile radius of Hyde Park Corner, that is beyond Chiswick to the west, Golders Green and Highgate Village to the north, Mile End to the east, and Streatham Hill and Tooting Bec to the south.

6. Meals

You are responsible for models' meals on bookings unless something else is agreed before the booking.

7. Mixed agency bookings

If models from another agency are working on the same assignment, providing the same services, at a higher rate, the Agency reserves the right to charge at that same rate.

8. Use of images

The initial media, territory and period of usage must be agreed before the booking and are set out on the booking confirmation we send you. It is your responsibility to tell us about, and agree fees for, any usage needed or anticipated after the time of booking, including extensions of an existing agreement. Photographs may not be used for any purpose until all fees have been paid in full.

9. Exclusion fees

A separate fee is agreed where work for a product precludes work for competing products. It is your responsibility to check whether conflicting work has been done. A model who advertises a product may work for any competitor unless an exclusion fee has been agreed.

10. Test and experimental photography

A photographer may not use test or experimental photographs for commercial purposes or resale unless agreed in writing with the Agency before the session.

11. Provisional bookings

A provisional booking is cancelled automatically if it is not confirmed within 24 hours of the proposed booking, or if a definite booking is offered for the same model and the provisional one cannot be confirmed.

12. Cancellation fees

  • Cancelled within three working days of the start time: the full fee, unless the same client rebooks the same model within 24 hours, in which case 50%.
  • Cancelled outside three working days but within five: 50% of the fee.
  • Cancelled outside five working days: 25% of the fee.
  • For trips and long bookings, cancellation within a period equal to the length of the booking is charged at the full fee.
  • No cancellation charge applies where the cancellation is caused by illness or anything else beyond the model's or the Agency's control.

13. Weather permitting bookings

This must be made clear at the time of booking. On a first cancellation 50% of the fee is charged, unless you fail to cancel in time to prevent the model attending, in which case the full fee is payable. On a second cancellation the full fee is charged.

14. Insurance

You will maintain adequate insurance to cover your obligations to the model. The Agency is not responsible if a model fails to attend, and you are advised to insure against any loss resulting from a model not keeping a booking because of ill health or anything else.

15. Copyright

The photographer may not use any image beyond the usage agreed, other than in their own portfolio, and agrees to restrict their copyright to that extent. If you are not the photographer, it is your responsibility to bring these terms to the photographer's attention and obtain their agreement before the shoot begins.

16. Complaints

Please raise any complaint with the Agency as it arises. Complaints cannot be considered in retrospect. While every effort is made to give clients a satisfactory service, the Agency is not responsible for a model's conduct, nor for costs arising from a model's lateness or non-appearance. Because fees are charged at the end of an assignment there are not normally circumstances in which refunds apply, but the Agency will consider any reasonable request.

17. This is the agency, not Model Development

These terms cover booking models from Ms Curvaceous Model Agency. Ms Curvaceous Model Development, which sells portfolio shoots, workshops and courses to individuals, is a separate part of the business with its own terms. Models never pay to apply to the agency, to be signed, or to be put forward for work.

18. General

All fees are negotiated only with Ms Curvaceous Model Agency, and the Agency may negotiate within the structure of these terms. Any agreement made by email will be honoured where it falls outside these terms. As a supplier of services, these terms take precedence over any terms received from you, including where those terms contain a similar clause to this one. Where an assignment has its own written terms agreed with us, those apply for that assignment and these terms cover everything they do not mention. These terms are without prejudice to any claim against the client, are governed by English law, and any dispute will be settled under that law by a court in England.
